Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Double AI Limited, trading as Caspian ("we", "us", or "Caspian"). By accessing or using our services, you agree to be bound by these Terms.

1. The Caspian Service

Caspian is a financial data aggregation and analytics platform that helps users manage and understand their financial information. Our services include:

Caspian does not provide regulated payment services. Open Banking access is provided through Finexer Ltd, which is authorised by the Financial Conduct Authority (FCA) under the Payment Services Regulations 2017. Double AI Limited (trading as Caspian) acts as an agent of Finexer Ltd, with Finexer as the FCA-authorised provider.

Caspian provides informational tools only. We do not provide financial, investment, tax, accounting, or legal advice. We do not execute payments, transfers, or any financial transactions on your behalf, and we do not act as a financial adviser.

2. Eligibility

To use Caspian, you must be at least 18 years old, have the legal capacity to enter into binding agreements, and provide accurate information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3. Connecting Financial Accounts

Connections to your financial institutions are made through Finexer Ltd's Open Banking infrastructure or alternative integrations. Authentication occurs directly with your bank — Caspian does not receive your banking login credentials.

Financial information displayed within the Services is provided for informational purposes only. You should verify any financial information directly with your financial institution before relying on it.

4. Transaction Enrichment and Third-Party Services

Caspian uses third-party services, including Ntropy, for transaction enrichment. We do not control the internal models used by such providers and cannot guarantee the accuracy of enriched data.

5. AI Features and Contextual Memory

Our AI systems analyse your data and generate insights to help you understand your finances. Information that you provide through conversations, prompts, notes, or other interactions may be stored as contextual memory to improve your experience.

AI-generated outputs are automated and may rely on probabilistic models or statistical inference. As a result, outputs may be incomplete, inferred, inaccurate or out of date. You should independently verify any AI-generated information before acting on it.

6. Shared Household Environments

Caspian allows multiple users to collaborate within shared household environments. Financial information from all participants becomes visible to household members, and contextual memory may be shared within a household environment.

8. Account Termination

You may terminate your account at any time. Caspian reserves the right to terminate or suspend your access with or without cause, and with or without notice, for reasons including breach of these Terms or suspected fraudulent activity.

9. Intellectual Property

Caspian owns all intellectual property rights in the Services. You retain ownership of your data. By using the Services, you grant Caspian a non-exclusive licence to host, store, process, analyse, enrich and display your information for the purpose of operating and improving the Services.

10. Availability of the Services

The Services are provided on an "as is" and "as available" basis. We make no warranties regarding accuracy, reliability, completeness, or timeliness of data or AI outputs.

11. Limitation of Liability

To the maximum extent permitted by law, Caspian excludes liability for financial losses, data inaccuracies, categorisation errors, and technical failures. AI-generated outputs may contain errors, incorrect inferences, or misleading conclusions.

Our maximum aggregate liability to you is capped at £100. Your use of the Services is entirely at your own risk.

You may contact us at [email protected] with any complaints. You may also escalate complaints to the Financial Ombudsman Service where applicable.

13. Privacy

Your data is collected and processed in accordance with our Privacy Policy, which forms part of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated with reasonable notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
